OVERVIEW

Welcome to 3CK Incorporated ("3CK," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, online store, and all related services, features, tools, and content (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms, our Privacy Policy, our Refund Policy, our Shipping Policy, and any other policies referenced herein (collectively, the "Policies"). If you do not agree, you must discontinue use of the Services.

 

The Services are hosted by Shopify. While Shopify provides the platform, all purchases are made directly with 3CK.

1. ELIGIBILITY & ACCOUNT RESPONSIBILITY

By using the Services, you represent that you are at least the age of majority in your jurisdiction, providing accurate and complete information, and authorized to use any payment method submitted. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. We may refuse service, terminate accounts, or cancel orders to prevent fraud, abuse, or violations of these Terms.

2. ACCEPTANCE OF ALL POLICIES

By using the Services, you acknowledge and agree that these Terms incorporate all other 3CK policies. Updates to any policy apply immediately upon posting. Continued use of the Services constitutes acceptance of updated Terms.

3. PRODUCT INFORMATION & AVAILABILITY

We strive for accuracy but do not guarantee that product descriptions, colors, images, or specifications are error-free. Colors may vary due to device settings. We may modify or discontinue products, limit quantities, or restrict sales at our discretion.

4. ORDERS, FRAUD SCREENING & RIGHT TO CANCEL

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order, cancel orders suspected of fraud or abuse, or request additional verification. You agree not to purchase products for commercial resale without written consent. Purchases are governed by our Refund Policy.

5. PRICING, BILLING & PAYMENT AUTHORIZATION

Prices may change without notice. Posted prices exclude taxes, shipping, duties, and import fees unless stated otherwise. By submitting payment information, you represent that it is accurate and authorized. We may refuse or cancel orders for pricing errors.

6. SHIPPING, DELIVERY & RISK OF LOSS

Delivery times are estimates only. Once we transfer products to the carrier, title and risk of loss pass to you. 3CK is not responsible for delays, customs holds, or carrier errors. Packages marked "Delivered" by the carrier are considered fulfilled. Customers must contact the carrier for lost or stolen packages. Incorrect addresses void delivery guarantees.

7. INTELLECTUAL PROPERTY

All content, trademarks, logos, designs, text, images, and media on the Services are owned by 3CK or its licensors. You may not copy, reproduce, modify, distribute, or create derivative works without written permission. All rights not expressly granted are reserved.

8. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or links. These are provided "as is" without warranties. We are not responsible for third-party content, products, or services.

9. RELATIONSHIP WITH SHOPIFY

Shopify hosts our store but is not responsible for your purchases, product quality, delivery, refunds, or disputes. You release Shopify from all claims related to your transactions with 3CK.

10. PRIVACY & ELECTRONIC COMMUNICATIONS CONSENT

By using the Services, you consent to our collection and use of personal information per our Privacy Policy and agree to receive electronic communications related to your orders, account, and legal notices.

11. FEEDBACK LICENSE

If you submit feedback, you grant 3CK a perpetual, worldwide, royalty-free license to use it for any purpose. You represent that you own the rights to any feedback submitted.

12. ERRORS & INFORMATION ACCURACY

We may correct errors, inaccuracies, or omissions at any time, including after an order is placed.

13. PROHIBITED USES

You may not use the Services to violate laws, harass others, upload malware, scrape data, impersonate others, or interfere with security features. Violations may result in account termination and legal action.

14. AGENTS & AUTOMATED ACCESS

Agents (including AI tools) must identify themselves, not mimic human behavior, and not bypass security measures. We may block or restrict Agent access at any time.

15. TERMINATION

We may suspend or terminate your access at any time for violations of these Terms. You remain responsible for all charges incurred before termination.

16. DISCLAIMER OF WARRANTIES

The Services and all products are provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure operation.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by law, 3CK is not liable for indirect, incidental, punitive, or consequential damages, including lost profits, revenue, or data. Your sole remedy is to stop using the Services.

18. INDEMNIFICATION

You agree to indemnify and hold harmless 3CK from claims arising out of your breach of these Terms, violation of laws, or misuse of the Services.

19. FORCE MAJEURE

We are not liable for delays or failures caused by events outside our control, including natural disasters, pandemics, war, supply chain disruptions, or government actions.

20. DISPUTE RESOLUTION, ARBITRATION & CLASS-ACTION WAIVER

All disputes will be resolved through binding arbitration. You waive your right to participate in class actions, class arbitrations, or representative claims. You also waive your right to a jury trial.

21. SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in effect.

22. ENTIRE AGREEMENT

These Terms and incorporated policies constitute the entire agreement between you and 3CK.

23. ASSIGNMENT

You may not assign your rights under these Terms. We may assign ours without notice.

24. GOVERNING LAW

These Terms are governed by the laws of the state where 3CK is headquartered.

25. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.
